Why Nnamdi Kanu was not sentenced to death – Judge

Justice James Omotosho of the Federal High Court in Abuja has given reasons for choosing a life sentence instead of the death penalty for Nnamdi Kanu, the leader of the Indigenous People of Biafra, after convicting him for terrorism offences.

The ruling came on Thursday, November 20, 2025, during the court session where the judge said that the law allowed the death penalty for the charges.

He explained that he chose a different path because he believed mercy should prevail, drawing from teachings in the Holy Book.

He pointed out that many countries are moving away from the death penalty and that religious values also guide people to show compassion.

The judge said Kanu should serve his sentence in a secure facility that matches his status.

He explained that the Kuje Correctional Centre would not serve the purpose of the judgment and ordered that the IPOB leader be held in protective custody at a safe location chosen by the authorities.

Justice Omotosho also directed that Kanu must not use electronic devices unless closely supervised by the Office of the National Security Adviser.

The court further ordered the Federal Government to take possession of the transmitter used for Kanu’s broadcasts.

It added that other devices linked to the case would be taken if no appeal is filed.
