The Attorney General of the Federation and Minister of Justice, Lateef Fagbemi SAN, is reportedly preparing a detailed response to the legal challenge initiated by a team of seven Senior Advocates of Nigeria representing governors from the Peoples Democratic Party (PDP).
This legal action is in direct opposition to the declaration of a state of emergency in Rivers State, which the PDP sees as an unconstitutional overreach.
The governors have assembled a formidable legal team, made up of some of the nation’s most experienced legal minds, to argue against the Federal Government’s actions.
Their suit is expected to raise significant constitutional questions, particularly around the justification of emergency rule in a democratic setting and the limits of presidential powers under such circumstances.
In response, AGF Fagbemi is said to be working closely with his legal team to defend the Federal Government’s position and uphold the emergency declaration, which was purportedly made in the interest of preserving order and stability in Rivers State.
