Court Asked to Remove Popular Nigerian Senator From Position


Three members of the African Democratic Congress (ADC) have filed a lawsuit at the Federal High Court in Abuja, asking the court to remove Senator David Mark and other interim leaders from their positions in the party.

The plaintiffs Adeyemi Emmanuel, Ayodeji Victor Tolu, and Haruna Ismaila are challenging the legality of Senator Mark’s appointment as Interim National Chairman, along with Rauf Aregbesola as Interim National Secretary and Bolaji Abdullahi as Interim National Publicity Secretary.

The aggrieved members argue that these appointments violate the party’s constitution and a previous court judgment.

They want the court to determine whether Senator Mark and the others were properly registered members of ADC and if they were qualified to hold leadership positions.

They also questioned whether interim leadership roles even exist in the ADC constitution since it is not a newly formed party.

The plaintiffs further claimed that the previous National Chairman, Ralph Nwosu, had no legal right to hand over the party’s leadership without following proper procedures, such as a national convention or a decision by the party’s National Executive Committee.

The case also raises concerns about whether the Independent National Electoral Commission (INEC) should legally recognise the interim leaders.

The plaintiffs are asking the court to declare the current interim leadership unlawful, unconstitutional, and void.

No date has been fixed yet for the court to hear the case.

This court action comes shortly after ADC was adopted as a platform by a coalition linked to former Vice President Atiku Abubakar to challenge President Bola Tinubu in the 2027 elections.

Following that announcement, the ADC leadership under Nwosu had declared the party’s structure dissolved to pave the way for new leaders aligned with the coalition.
