Supreme Court will accept fresh evidence – Atiku to Tinubu

2023 PDP presidential candidate and former vice president, Atiku Abubakar has told president Bola Tinubu that the supreme Court will accept the fresh evidence he is set to present on Monday

Atiku Abubakar, the Peoples Democratic Party (PDP) candidate, has urged the Supreme Court to accept fresh evidence from the Chicago State University (CSU) that questions the eligibility of President Bola Tinubu, the All Progressives Congress (APC) candidate.

Atiku claimed this evidence will not only demonstrate Tinubu’s ineligibility but also suggest certificate forgery on his part.

Atiku, who obtained a 32-page document from CSU based on a court order, had faced objections from President Tinubu, the Independent National Electoral Commission (INEC), and the APC regarding the admissibility of these documents.

However, Atiku’s legal team argued that there is no constitutional limit of 180 days for the lower court to hear and determine a presidential election petition, which should allow the Supreme Court to consider the fresh evidence.

Furthermore, Atiku pointed out that the Constitution grants jurisdiction over presidential election disputes exclusively to the Court of Appeal, and it does not impose the 180-day limit on this level of adjudication.

The Supreme Court has scheduled a hearing for Monday, October 23, in response to Atiku’s petition against Tinubu.
